These Terms of Use (hereinafter referred to as "Terms") govern the online shops (hereinafter referred to as "Service") provided by PACIFICO Yokohama (hereinafter referred to as "PACIFICO") on this website. Registered users (hereinafter referred to as "Users") are required to use this Service in accordance with these Terms.

Article 1 (Applicability) These Terms apply to all relationships related to the use of this Service between Users and PACIFICO. In addition to these Terms, PACIFICO may establish various provisions (hereinafter referred to as "Individual Provisions") such as a cancellation policy. These Individual Provisions shall form part of these Terms regardless of their name. If the provisions of these Terms conflict with the provisions of the Individual Provisions, the provisions of the Individual Provisions shall prevail unless otherwise specified.

Article 2 (User Registration) To use this Service, applicants must agree to these Terms, apply for user registration in the manner specified by PACIFICO, and receive approval from PACIFICO. User registration is completed when PACIFICO notifies the applicant of the approval. PACIFICO may deny registration if the applicant falls under any of the following conditions, and PACIFICO is not obliged to disclose the reason:

  1. Providing false information during the registration process
  2. Previous violation of these Terms
  3. Other reasons deemed inappropriate by PACIFICO

Article 3 (Sales Agreement) A sales agreement is concluded when a User applies for registration to PACIFICO and PACIFICO notifies the User of the acceptance. PACIFICO may cancel the sales agreement without prior notice to the User if the User:

  1. Violates these Terms
  2. Damages the relationship of trust between PACIFICO and the User The payment method and the cancellation method related to user registration will be determined separately by PACIFICO.

Article 4 (Intellectual Property Rights) The copyright and other intellectual property rights of product photos and other content (hereinafter referred to as "Content") provided by this Service belong to PACIFICO and legitimate right holders such as content providers. Users may not reproduce, reprint, modify, or otherwise use Content for secondary purposes without PACIFICO's permission.

Article 5 (Prohibited Actions) Users shall not engage in the following actions when using this Service:

  1. Violating laws or public order and morals
  2. Committing criminal acts
  3. Infringing on copyrights, trademark rights, and other intellectual property rights included in this Service
  4. Damaging or interfering with our servers or networks
  5. Using information obtained from this Service for commercial purposes
  6. Interfering with the operation of this Service
  7. Unauthorized access or attempts to gain unauthorized access
  8. Collecting or accumulating personal information about other Users
  9. Impersonating another User
  10. Benefiting antisocial forces directly or indirectly
  11. Any other actions deemed inappropriate by PACIFICO

Article 6 (Suspension of Service Provision) PACIFICO may stop or suspend the provision of all or part of this Service without prior notice to Users if any of the following reasons apply:

  1. Maintenance, inspection, or updating of the computer system related to this Service
  2. Difficulty in providing this Service due to force majeure such as an earthquake, lightning, fire, power outage, or natural disaster
  3. Stoppage of the computer or telecommunication line due to an accident
  4. Other reasons making it difficult to provide this Service PACIFICO shall not be liable for any disadvantage or damage suffered by Users or third parties due to the suspension or interruption of the Service provision.

Article 7 (Usage Restrictions and Deregistration) PACIFICO may restrict the use of all or part of this Service or cancel the registration without prior notice if:

  1. Users violate any provision of these Terms
  2. False information is reported in the registered information
  3. The credit card notified by the User as a payment method is suspended
  4. There is a default of payment obligations such as fees
  5. There is no response to contact from PACIFICO for a certain period
  6. PACIFICO deems the use of this Service inappropriate PACIFICO shall not be liable for any damage caused to Users due to actions taken based on this article.

Article 8  (Disclaimer of Warranty and Limitation of Liability)

PACIFICO does not guarantee that the Service will be free from defects, whether factual or legal (including but not limited to safety, reliability, accuracy, completeness, effectiveness, suitability for a specific purpose, security, errors, bugs, or rights infringements).

PACIFICO shall not be liable for any damages incurred by Users as a result of using this Service. However, if the contract between PACIFICO and Users regarding this Service (including these Terms) constitutes a consumer contract under the Consumer Contract Act, this disclaimer shall not apply. Even in such cases, PACIFICO shall not be liable for damages arising from special circumstances (including cases where PACIFICO or the User foresaw or could have foreseen such damages) caused by default or tort due to negligence (excluding gross negligence) of PACIFICO.

PACIFICO is not responsible for any transactions, communications, or disputes that occur between Users or between Users and third parties regarding this Service.

Article 9 (Changes to Service Content) PACIFICO may change the content of this Service without notifying Users and shall not be liable for any damage caused to Users.

Article 10 (Changes to Terms) PACIFICO may change these Terms at any time without notifying Users if deemed necessary. If Users start using this Service after changes to these Terms, Users are deemed to have agreed to the changed Terms.

Article 11 (Handling of Personal Information) PACIFICO will handle personal information acquired through the use of this Service appropriately in accordance with our "Privacy Policy."

Article 12 (Notification or Contact) Notification or communication between Users and PACIFICO shall be made by the method specified by PACIFICO. PACIFICO considers the currently registered contact information as valid and notifies or contacts the User unless the User notifies the change according to the method specified by PACIFICO.

Article 13 (Prohibition of Transfer of Rights and Obligations) Users may not assign their status under the sales agreement or the rights or obligations based on these Terms to a third party or provide them as collateral without the prior written consent of PACIFICO.

Article 14 (Governing Law and Jurisdiction) These Terms shall be construed and interpreted in accordance with the laws of Japan. Any disputes arising out of or in connection with this Service shall be submitted to the exclusive jurisdiction of the Yokohama District Court at the first instance.

Cancellation Policy

  1. PACIFICO is unable to refund the registration fee in case of cancellation at your convenience.
  2. If you are unable to attend the event on the day due to circumstances, please notify us as far in advance as possible. (In such cases, the registration fee will not be refunded.)
  3. If a registered person is unable to attend due to circumstances, it is possible to change the participant within the same organization. In such cases, please contact us in advance to change the registration details. There will be no additional costs associated with the above changes.

Privacy Policy

  1. Personal Information Compliance and Management PACIFICO protects personal information in its possession pursuant to the laws and regulations (including the Personal Information Protection Law) and appoints a representative manager at each department to handle and manage the personal information appropriately. PACIFICO establishes personal information protection regulations and guides all employees to prevent unauthorized access to, and loss, destruction, modifications, and leakage of personal information.

  2. Acquisition of Personal Information PACIFICO acquires personal information through legal and fair measures by clarifying the purpose, the range of use, and PACIFICO's contact persons.

  3. Use Purpose of Personal Information PACIFICO uses the personal information obtained from its customers for the following purposes:

  4. For PACIFICO's facilities and procedures and contact information necessary for its business activities.

  5. For public relations regarding PACIFICO's facilities and business activities

  6. For statistics and analysis on the use of the facilities and provision of services

  7. For developing new services and businesses and for conducting customer satisfaction surveys

  8. For sending PACIFICO's public relations magazines, event brochures, and invitation cards

  9. For following the guidance and instructions of administrative authorities

  10. For purposes clearly specified upon the acquisition of personal information

  11. Limited Use of Personal Information PACIFICO uses its customers' personal information only for the purposes specified above. If personal information is to be used for any other purpose, PACIFICO will notify the customer in advance.

  12. Limited Provision of Personal Information to Third Parties PACIFICO does not disclose or provide its customers' personal information to any third party except in the following cases:

  14. When permitted by laws and regulations

When necessary to cooperate with administrative authorities for a special reason PACIFICO may share its customers' personal information with designated contractors or outsource handling of the personal information to other contractors to fulfill its responsibilities specified in the contract with the customer and to provide better facilities and services. PACIFICO prevents leakage of personal information from and secondary provision by the contractors and handles, manages, and controls the information properly under a nondisclosure agreement.

  16. Disclosure, Correction, and Deletion of Personal Information If a customer requests disclosure, correction, or deletion of personal information, PACIFICO will promptly respond after confirming the customer's identity, except in the following cases:

  17. If there is a risk of harm to the life, body, or property of the customer or third parties or other rights may be infringed

  18. If public safety and order may be compromised

  19. If PACIFICO's business may be obstructed

  20. If disclosure of personal information is not permitted under laws and regulations

  21. If PACIFICO cannot confirm the customer's identity

  22. Continuous Review of Personal Information PACIFICO will continuously review and improve the regulations and management system of personal information, including this Privacy Policy.

Privacy Notice for Events

  1. Conditions for "Ordinary" personal data

  2. Users agree that PACIFICO may process personal data of users on the CRM system used by PACIFICO and may communicate with users via email, post, or other methods with important messages relating to the forum.

  3. Users agree that PACIFICO may add personal data of users to their CRM system, where PACIFICO maintains records of the forum participants.

  4. Special opt-in conditions for Sensitive personal data PACIFICO will always handle some personal data regarded as particularly sensitive with an appropriate level of care.

  5. Photography and Video Material Photos and videos taken at the event & tours may be reproduced in the promotional material of PACIFICO Yokohama. This includes, but is not limited to, any print or electronic media (including social media) and websites. PACIFICO reserves the right to crop, splice, treat, and edit any imagery or photographs taken at the event & tours. Users waive the right to inspect or approve the finished product, including written or electronic copy. Additionally, all rights to royalties or other compensation arising or related to the use of the name, photograph, or biography are waived by users or employees of users. All photographs and video materials taken at the forum become the property of PACIFICO. The material related to this forum may not be photographed, drawn, copied, or reproduced without the prior written consent of PACIFICO. Users have the right to request the removal of their picture. If users wish to have their picture or video removed, please contact PACIFICO, and actions will be taken accordingly.
